Texas residents may not have to settle a judgment if they are selling or refinancing their homestead.
Texas Partial Release
Thanks to Texas Homestead laws a judgment creditor can not cloud your homestead title. In short, they can not force you to pay or settle a judgment when you refinance or sell your homestead home. When you apply and receive a Texas Partial Release, the judgment does not go away. You still owe the judgment creditor. Keep in mind at least 5% interest still accrues yearly on a judgment in Texas. A Texas Partial Release allows you to sell or refinance you home without paying or settling with the judgment creditor.
