Thousands of Hurricane Harvey victims are subject to losing their homes this upcoming Tuesday if the State of Texas does not act quickly to place a moratorium on all foreclosure sales in all counties effected by Hurricane Harvey.  Failure of the Governor and/or other State or Local officials to immediately declare a halt to all foreclosure sales scheduled to occur on Septemebr 5, 2017 in all affected counties would be a catastrophic mistake that would make Texas and FEMA look like Louisiana after Katrina.

John Gannon Helstowski, who is the owner of the Helstowski Law Firm, and one of the strongest advocates for Texas homeowners facing foreclosure, has made a formal, written request upon Governor Abbott and the State of Texas to issue such a moratorium. See attached letter.

Each month, lien holders are allowed to conduct non-judicial foreclosure sales on the first Tuesday of the month, and pursuant to the Texas Rules of Civil Procedure, any homeowner facing foreclosure has the legal right to seek redress in the District Court in their county of residence and request a temporary restraining order and/or temporary injunction to stop a pending foreclosure sale. However, given that all Courts are currently closed in the disaster affected counties, and will likely remain closed until Tuesday September 5th, it would be a travesty of justice to allow foreclosure sales to continue under these circumstances.  If you cannot have your day in court, then why should you loose your most precious asset?

We are asking all media outlets to assist in relaying this very important message and request to the Governor and other State and Local officials so that they can please heed and give serious consideration to Mr. Helstowski’s warning and request, and together we can provide temporary relief to the victims of Hurricane Harvey.
